Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BestSeat360 website (bestseat360.tv), mobile applications, live and on-demand streaming services, and any related features (collectively, the "Service"), operated by BestSeat360 Limited ("we," "us," or "BestSeat360").

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement. We may update them from time to time. Your continued use after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction. If under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms.

3. Account Registration & Security

Certain features require registration. You must provide accurate information and keep it current. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscriptions & Billing

  • Subscriptions are offered on a recurring basis unless otherwise stated.
  • All payments are processed in the currency shown at checkout and are non-refundable except where required by law.
  • Subscriptions auto-renew unless canceled at least 24 hours prior to renewal.
  • We reserve the right to adjust pricing or suspend access for non-payment or violation of these Terms.

5. Content License & Usage Rights

All content (including live streams, on-demand videos, multiview feeds, graphics, and commentary) is owned by BestSeat360, our licensors, event organizers, or content partners and is protected by copyright and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and view the content solely for your private, non-commercial use during your active subscription period. You may not:

  • Record, copy, reproduce, distribute, transmit, or publicly perform any content
  • Modify, create derivative works from, or remove any copyright notices
  • Use the content for commercial purposes or in any unauthorized manner

6. Prohibited Conduct

You agree not to:

  • Circumvent, disable, or interfere with any security features, geo-restrictions, or digital rights management
  • Use automated means (e.g., bots, scrapers) to access the Service
  • Upload, transmit, or distribute viruses, malware, or harmful code
  • Harass, impersonate, or intimidate other users
  • Attempt to access content you are not authorized to view
  • Use the Service in violation of any applicable law or third-party rights

7. Live & Multiview Streaming

  • Content availability is subject to licensing agreements, event schedules, broadcast rights, and technical limitations.
  • We do not guarantee continuous, uninterrupted, or error-free streaming.
  • Certain camera angles (e.g., jockey cams, referee cams) may contain sensitive content and are subject to additional restrictions imposed by rights holders.

8. Termination & Suspension

We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms, non-payment, or any other reason we deem appropriate. Upon termination, your right to use the Service ends immediately.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BestSeat360, its affiliates, officers, directors, employees, and licensors from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Auckland, New Zealand. You waive any right to a jury trial or to participate in a class action.

12. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time without liability.
